1. The provider

2. The service

The provider rents out recreational small boats without a skipper, on an hourly basis. The 20 HP boat (max. 14.7 kW) may be driven without a boat licence. The 40 HP boat may only be driven with a valid recreational small craft licence, which the renter presents at handover.

3. The renter and the driver

• The renter and the person driving the boat are at least 18 years old and prove their identity at handover.
• The person driving the boat must not be under the influence of alcohol, drugs or medication that impairs the ability to drive. If this is suspected, the provider refuses the handover; in this case the deposit paid is not refunded.
• A maximum of 5 people may be on board. The provider supplies life jackets; children must wear them.
• Before handover, the renter attends a safety briefing and must comply with the Hungarian navigation rules and the provider’s instructions.

4. Booking and deposit

• Bookings can be made online or by phone. For online bookings, 30% of the rental fee is paid as a deposit by bank card via the Stripe payment system. The contract is concluded upon successful payment of the deposit; the renter receives a confirmation by e-mail.
• After payment has been started, the provider holds the time slot for 30 minutes. If the deposit is not received within this time, the booking is cancelled.
• The renter pays the remaining rental fee on site at handover.
• Prices shown on the website are final amounts and are valid until revoked.

5. Security deposit

At handover the renter pays a security deposit of HUF 60,000 in cash. It is refunded when the boat is returned on time, undamaged and in proper condition. In case of damage, missing items, heavier than usual soiling (extra cleaning: HUF 25,000) or late return, the provider deducts the cost from the security deposit. The renter is liable for damage exceeding the security deposit under the Hungarian Civil Code.

6. Cancellation, changes, weather

• The renter may cancel the booking free of charge at least 48 hours before departure; the provider refunds the deposit within 8 days.
• For cancellations within 48 hours or no-shows, the deposit is not refunded.
• In case of a storm warning, strong wind, high or low water, official restrictions or any other reason preventing safe navigation, the provider may postpone the trip. The renter may then choose a new date free of charge or request a refund of the deposit.
• If the renter is late, the rental time is not extended if the boat must be returned for the next booking.

7. Navigation area

• The 20 HP boat may be used on the Szentendre branch of the Danube. If the Budapest gauge is below the lowest navigable water level (LNWL, 93 cm), the renter must contact the provider in advance; in that case the 20 HP boat may be used on the main branch after a briefing, upstream towards Göd.
• The 40 HP boat may be used with a valid boat licence from the southern edge of Budapest up to Esztergom, on both the Szentendre branch and the main branch.
• Designated prohibited areas are not part of the rental area. The route must be agreed with the provider before departure.

8. Right of withdrawal

For contracts for leisure services provided on a specific date, consumers have no 14-day right of withdrawal under Section 29(1)(l) of Hungarian Government Decree 45/2014 (II. 26.). The cancellation terms are set out in point 6.

9. Complaints

Complaints can be submitted to kishajoberles@gmail.com or by phone; the provider replies in writing within 30 days. In consumer disputes you may turn to the Budapest Conciliation Board (Budapesti Békéltető Testület).

10. Miscellaneous
